The purpose of this privacy policy is to describe the different data processing that BVA mystery Shopping (hereinafter “BVAMS”) implements as part of its activity of recruiting investigators and translators with potential candidates and in the context of a request for information via the “Contact Us” form.

BVAMS attaches great importance to the protection of your personal data and ensures the compliance and legality of its processing with the legislation and regulations applicable in France and in Europe and in particular Regulation 2016/679 of April 27, 2016.

This privacy policy comes into force from its publication and applies to all personal data that BVAMS collects and/or has collected as part of its activity of recruiting interviewers and translators and any person who communicates personal data to them and/or contracts with them.

1. THE PURPOSE OF DATA PROCESSING BVA MYSTERY SHOPPING INVESTIGATORS

As part of its activity and on its website, BVAMS offers people the opportunity to fill in forms in order to apply to become a mystery shopper or translator or to receive information.

The forms through which BVAMS collects personal data on its site are:

  • “Become a Mystery Shopper” form
  • “Contact us” form

1.1 PURPOSE

The purpose of processing your data is to take into account your application for possible recruitment or to enable you to send a request/question to BVAMS.

This processing allows BVAMS to:

  • Receive your application to become a mystery shopper or proofreader/translator
  • Reply to requests/questions sent by the internet user via the “Contact us” form

1.2 LEGAL BASIS

Article 6 (1) a, b, c, and f of the General Data Protection Regulation (hereinafter “GDPR”)

The data is collected because the person concerned has consented to the processing of his or her personal data for one or more specific purposes such as submitting an application to become a mystery shopper or proofreader/translator and/or applying for and receiving information and/or the processing is necessary for the performance of a contract to which the person concerned is a party and/or is necessary to comply with a legal obligation to which BVAMS is subject.

The data collected enables BVAMS to identify you, to proceed with the study of your application, to contact you, to respond to one of your requests and in general to ensure the execution of the contractual relationship it concluded with you.

2.1 DATA SOURCE

The data is collected directly from the persons concerned as part of the various collection forms on the BVAMS website.

2.2 COMPULSORY NATURE OF DATA COLLECTION

The data collection fields marked with an asterisk are compulsory: without this data, we cannot accept your application and/or reply to you.

2.3 AUTOMATIC DECISION MAKING

The processing is not subject to any automated decision-making.

3. PERSONS CONCERNED

The data processing only concerns people who wish to receive information and/or apply to become a mystery investigator.

4.DATA RECIPIENTS

4.1 CATEGORIES OF RECIPIENTS

Within BVAMS, the recipients of the data are:

  • The recruitment department
  • Human resources department
  • The financial and administrative department
  • The accounting department
  • General management

4.2 TRANSFER OF DATA/TRANSFER OUTSIDE THE EU

Within the framework of the execution of the contract which you conclude with BVAMS or a request for information made with BVAMS, no data is transferred outside the European Union.
In the event that we use a third party partner located in a country recognised by the European Union as inadequate in terms of the protection of personal data, BVAMS requires it to comply with its security and confidentiality requirements in the processing of your personal data. These partners will have previously signed the European Commission’s standard contractual clauses.

5. DATA RETENTION PERIOD

BVAMS keeps the data collected in accordance with legal and regulatory periods and in accordance with the recommendations of the CNIL.
With regard to contracts, the data is kept for the entire duration of the contract, and for the period of the limitation of actions which is 5 years, except legal exceptions.
When your application is not selected, BVAMS keeps your CV for a period of 2 years from the date of submission after obtaining your consent.
BVAMS keeps the data of your investigator/translator/proofreader account in accordance with the rules applicable to the periods of limitation and the legal and regulatory provisions applicable in this regard.

6. SECURITY

BVAMS implements the means necessary for the security and confidentiality of your data and in particular:

  • Limits access of your data to authorised persons
  • Data encryption
  • Logging of connections
  • Technological security measures (firewall and anti-virus software)

8. YOUR RIGHTS ON THE DATA CONCERNING YOU

You may exercise your right to access, oppose, rectify or delete and limit the processing of your data.

You can also obtain a copy of your personal data.

You also have the right to formulate specific or general instructions regarding the storage, deletion and the communication of your post-mortem data. To exercise of this right, a letter must be sent by post to the data protection officer whose contact details are given below. Requests regarding the fate of post-mortem data must be accompanied by a copy of an identity document in order to be taken into account.
